I purchase a Studio unit in San Antonio Residences and still paying 30k monthly for my DP, I just purchase the unit 11 months ago. I quit to my previous job and work to a company which is offer me lower salary.

I tried to pay but now I decide to cancel my contract with mega world. Is there a chance for me to get my refund at list 50%? I cant contact mega world, if I call no one answer and let me wait for almost 1hr.

I really need my money back. Hope someone can help me here.

Reason of review: Poor customer service.

Monetary Loss: $270000.

Preferred solution: Full refund.

Go to HLURB and file case directly. Do not undergo mediation.

Its a waste of time. Get the format of the paper and have it notarize . You dont need a lawyer for this. Before you file case make sure you have the proof payments and the copy of contract.

Get a copy of statement of account, contract to buy and sell, official receipts in the Account Management Department 17th floor Alliance Global Tower. Make sure in your paper you emphasize that you are qualified for the refund under MACEDA Law because you have pay not less than 24 payments including reservation and down payment. You dont need a lawyer in every hearing. If in case you need advice, feel free to consult in PAO.

It would take time but be patient.

Be confident. If you completed 24 payments HLURB will be on your side.

Getting a full refund can only be possible (based on Maceda law/PD957) if they failed to turnover the unit within the period you agreed upon as per the contract. Maceda law states that the buyer may get 50% refund if he/she paid the developer for at least 24 months.

However, I haven't gotten my refund yet even if I qualify to get 50%. I had a conciliation conference with Megaworld and HLURB staff last month but Megaworld insisted that they wouldn't issue a refund so HLURB staff told me that my only option is to file a case at their office. I'm still searching for a real estate lawyer who had won a case against Megaworld. Going back to your case, Maceda law can only offer 60 days grace period from the time a buyer failed to pay the monthly amortization fees.

You can try to find a buyer though Megaworld will apply an assignment fee of 300K pesos for that transfer.

You can add that 300K to your selling price depending on the unit's market value. If the unit will be turned over soon, you can just continue paying for it until the time you can have it rented out for 30K (or more) monthly or 2K per day.

Guys, please don't trust Megaworld or Empire East!Manhattan Heights Tower is owned by Megaworld, but the lot is owned by Araneta.It's not a perpetual ownership, you buy from them you might benefit from staying the place but not a herlum to your next generation.They are so good with regards to Marketing strategies, however study first and do more research before buying properties.

They do the same with me after paying USD$50,000 no one contacted me and saying that I just received a letter of penalty.is there a resolution on this

I suggest you contact your agent or send a letter back to that person who sent you your statement of account. BTW, I hope you received your official receipt for your payment as well as the original copy of contract.

I have the same problem and i have no idea where to get help. Megaworld offer to refund 50% which means they will half of 1.6M pesos that we put in.

We agree coz its like there is no other options.

Now its more than one year since we applied for refund and still on the process. Its crazy

NOTHING! And they even tried to take some money on my bank account...

But my account was bounced cause there is no money anymore...Im trying to contact them but the phone is always busy.... Sorry my English is bad

If you have paid for 2 years, you can get a refund of 50% under Maceda Law.If the process is taking decades to finish, might as well go to Public Assistance Office and ask for help from a lawyer. You will go to HLURB and file a case for them to give back 50% of the amount you paid.
